South Dakota does not license public adjusters
No public adjuster licensing requirement exists in South Dakota.
Without state licensing, there is no regulator-maintained roster, no statutory fee cap, and no state-supervised complaint process for public adjusting services.
What you can do instead
- 1. Contact your state's insurance department — it's free.
The South Dakota Division of Insurance mediates insurance complaints and can demand a carrier response at no cost to you. This is available in every state regardless of public adjuster licensing.
- 2. Consult a policyholder-side insurance attorney.
An attorney who handles first-party property insurance disputes can review your claim, negotiate with the carrier, and litigate if needed. Ask about fee structures — some work on contingency, others bill hourly. The State Bar of South Dakota lawyer referral service can help you find one.
- 3. Check your policy's appraisal clause.
Many property insurance policies contain an appraisal provision for disputes about the amount of a loss. Each side selects an appraiser, and a neutral umpire breaks ties. Check your policy's "Loss Settlement" or "Appraisal" section — the right may already be there.
- 4. Document everything from day one.
Photograph all damage before any repairs beyond emergency mitigation. Keep every receipt, every email, every adjuster's card. This documentation is your leverage regardless of who helps with your claim. Our claim letter templates and claim-type guides are free tools built for exactly this.
- 5. Use the tools that apply everywhere.
